Power Home Remodeling Group Privacy Notice

We respect your privacy and know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully. This Privacy Notice describes how Power Home Remodeling and its affiliates (collectively “Power”) collects, uses, shares, and protects information about you through its websites (the “Sites”), products, services, and applications that reference this Privacy Notice (together “Power Services”). This Notice contains important privacy disclosures. By using Power Services, you are consenting to the practices described in this Privacy Notice.

What Personal Information About Customers Does Power Collect?

When you interact with Power Services, we collect your personal information to provide and continually improve our products and services. The types of personal information we collect:

  • Information you provide us: contact and identification information (name, address, telephone number, email address, driver’s license number, date of birth, and social security number); payment information (payment card number, and expiration date); demographic information (age, gender, income range, and occupation); financial information (submitted on credit applications for our services); details about your property and projects (photographs and videos); and employment information (submitted on a job application).
  • Automatic collection: We automatically collect and store certain types of information about your use of Power Services, including information about your interaction with products, content, and services available through Power Services. Like many websites, we use cookies, web server logs, web beacons, and other unique identifiers, and we obtain certain types of information when your web browser or device accesses Power Services and other content served by or on behalf of Power on other websites. Our employees may use cameras and other technology to gather information about your property and project while in the community.
  • Information from Other Sources: Power may receive information about you from other sources, as explained below.

Cookies Disclosure

Our online services may use HTTP cookies, HTML5 cookies, Flash cookies, and other types of local storage (such as browser-based or plugin-based local storage) to enhance user experience and analyze performance, user activity, and traffic on our Sites. Cookies are small text files that websites send to your computer or other internet-connected device to uniquely identify your browser or to store information or settings. Your browser may provide the ability to be notified when you receive certain types of cookies and how to restrict or disable certain cookies. These settings generally do not work for Flash cookies, but you may be able to delete your Flash cookies or adjust your Flash cookie settings by visiting the Adobe Flash Website Storage Settings Panel and Global Storage Settings Panel. The Sites recognize the Global Privacy Control (“GPC”), which is designed to recognize certain browser-based opt-out preference signals. To process your opt-out request through GPC, you must use a browser or extension supporting the preference signal, and you will need to turn it on for each browser and each device you use. Please note that if you disable cookies, you may not be able to use all of the features and functions of our online services.

Server Logs

Our Sites generally use web server logs to record information about your use of Power Services, in the form of usage data, such as:

  • Your device type, operating system type, browser type, domain, system settings, and IP address, as well as the language your system uses and the country and time zone where your device is located;
  • The address of the web page that referred you to our Sites and other information about your interaction with our websites, such as which pages you visit.

This is a common practice that supports the operation of our online services.

Web Beacons

Our web pages and emails may contain tags known as “web beacons” or “single pixel gifs,” which are small electronic images used to help deliver cookies on our sites, count visitors to our webpages, determine whether emails are opened, and deliver co-branded services. We may also work with other companies by sharing information about the use of our beacons or placing web beacons on their sites or in their advertisements to let us develop statistics on how often clicking on an advertisement or product on our sites results in a purchase or other action on other sites. Our web pages may also contain web beacons from third parties, which help us compile aggregated statistics regarding the effectiveness of our promotional campaigns or other website operations. These web beacons may allow the third parties to set or read a cookie on your computer.

Third-Party Analytics

We may also use third-party web analytics services in our online services, such as those of Google Analytics. These service providers help us analyze how users use our online services. Information collected as a part of Google Analytics (including your IP address) is automatically sent to Google, and Google may place cookies to help with the analysis. Information We Collect by Automated Means Offline

When you call our customer service center, we may record audio of the conversations for quality control, training, security, and analytics purposes.

Information We Collect From Other Sources

We may obtain certain information about you from other businesses. For example, the information we may receive about you includes but is not limited to:

  • updated addresses or phone numbers we obtain from vendors who maintain such data;
  • information about you from individuals, such as through “Refer a Friend” programs;
  • information from public sources, such as information you submit in a public forum (for example, a customer review); and
  • credit history information and lender approvals, which we use to help prevent and detect fraud and to offer certain credit or financial services to some customers.

How We Use Your Personal Information

We use your personal information to operate, provide, develop, and improve the products and services that we offer our customers. These purposes include:

  • Provide and deliver products and services, track your purchases, process payments, service projects, and communicate with you about Power Services via different channels;
  • Recommend products, and services that might be of interest to you, identify your preferences, and personalize your experience with Power Services;
  • Publish public reviews as submitted by you and other customers;
  • For market research, data analytics, and system administration purposes.
  • To provide custom content and ads to you on this and other websites, including as described in the Interest-Based Advertising section below;
  • To protect against and prevent fraud and unauthorized transactions, investigate and manage claims, risk exposure, quality, and generally improve security;
  • In certain cases, to comply with our legal obligations, enforce applicable legal requirements, industry standards, and our policies, such as our Terms and Conditions.
  • To evaluate your job application for employment and contact you regarding possible employment opportunities.

How We Share Information

We do not sell, trade, or otherwise transfer personally identifiable information to unaffiliated third parties without your consent, except as described below.

Service Providers and Business Partners

We may disclose your personal information to companies that provide services to us (such as providers of hosting, support, delivery, printing, email, data enhancement, and repair services) or that help us market our products and services. These companies may need access to information about you to perform their functions. These companies are generally not authorized to use the information we disclose to them for any other purpose. In limited cases, we may disclose information about you to a third party who may also use the information for their own specific purpose. For instance, we may provide information on your behalf to a supplier in connection with warranty service or product safety issues or with a business partner who is jointly providing a product or service to you or is running a jointly branded promotion with Power. We may also share limited information with banks or financial institutions that offer credit accounts.

Legal, Enforcement, Security and Investigation

We may disclose information about you (1) if we believe we are required to do so by law, regulation, or legal process, such as a court order or subpoena; (2) as we deem appropriate or necessary in response to requests by government agencies, such as law enforcement authorities or tax authorities; (3) when we believe disclosure is appropriate or necessary to protect the rights, property, or safety of our customers, or others, including to prevent physical, financial or other harm, injury or loss, or to collect debt you owe; or (4) in connection with an investigation of suspected or actual unlawful activity.

Sale or Transfer of Business or Assets

We reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including, without limitation, in the event of a reorganization, dissolution, or liquidation).

Aggregate or De-Identified Data

We may share or make public aggregate or de-identified data derived from personally identifiable information. Such information, however, will not identify you or any other individual.

How We Protect Your Information

We maintain administrative, technical, and physical safeguards designed and intended to protect personal information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use. We work to protect the security of your personal information during transmission by using encryption protocols and software. Despite these safeguards, due to inherent uncertainty in the use of the internet and information systems and the potential for unlawful attacks by third parties, we cannot guarantee that the use of our Sites and information systems will be completely safe or secure. We retain information for as long as it is needed or useful to provide and improve our products and services, comply with our legal obligations, resolve disputes, and enforce our agreements.

Your Information Choices

You can choose not to provide certain information, but then you might not be able to take advantage of many of the Power Services. Where applicable, you may manage and amend your preferences regarding how we communicate with you as outlined in more detail below. We strive to comply with all reasonable requests, but there may be a short delay in the processing of such requests.

Please include your name, address, phone number and email address in the request, and if possible, let us know how you initially provided us with the information.

To stop receiving marketing emails, you may click on the “Unsubscribe” link in any marketing email you receive from us and update your preferences on the resulting web page. You may also update your email subscription choices by contacting us as described in the How to Contact Us section below. Please note that we may continue to send transactional emails, which contain information about a prior purchase or an ongoing service, even if you opt out of marketing emails. In addition, to the extent required by applicable law, you may have the right to request access to or the deletion of your personal information in which case you should contact us at the options provided above.

Intellectual Property Ownership

POWER HOME REMODELING, POWER, the P Logos, and associated taglines and logos are names, trademarks, and registered trademarks owned exclusively by Power Home Remodeling. All other trademarks are the exclusive rights of their respective owners and are used with permission. The Sites are protected by copyright law and are the exclusive property of Power Home Remodeling. Reproduction or distribution of the Sites or any part thereof without express written permission from Power Home Remodeling is strictly prohibited by law.

Do Not Track

We do not collect personally identifiable information about users’ online activities over time and across third-party websites, and we do not process or respond to “Do Not Track” signals from your browser or other mechanisms that enable consumer choice regarding the collection of personal information about one’s online activities over time and across third-party websites or online services.

Links to Other Websites

The Sites may link to other websites for your convenience and information. For instance, they may link to the websites of product suppliers, manufacturers, and service providers. These websites may be operated by companies not affiliated with Power. Linked websites may have their own privacy notices, which we strongly suggest you review if you visit them. We are not responsible for the content or privacy practices of any website or third party that we do not control, and that does not point to this Notice. Your interactions with these websites are governed by the privacy policies of the companies operating those websites.

Children’s (COPPA) Privacy Policy Notice

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians about our practices for collecting, using, and disclosing personal information from children under the age of 13. Power does not knowingly collect personally identifiable information from children under the age of 13. If a child under the age of 13 has provided us with personally identifiable information, we ask that a parent or guardian contact us, at the options provided above, so that the information can be promptly deleted.

State-Specific Privacy Disclosure

Please refer to the additional “State-Specific Privacy Disclosure,” also located on the Sites as required under applicable laws.

Scope of This Notice

This Notice applies to the personal information we collect in one or more of the following ways: use of the Sites; phone, email, and other electronic or written communications; visits to our locations or other in-person events; social media interactions; surveys, contests and sweepstakes; and online advertisements.

This Notice does not apply to: credit-related products issued by banks or financial institutions, which are covered by separate privacy notices that appear on the credit applications or that you receive in connection with your credit accounts; and third-party websites that are linked to or accessible from our website or that are operated by unaffiliated parties, even though the website may contain references to Power Home Remodeling.

This Notice may be updated periodically and without prior notice to you to reflect changes in our information practices or relevant laws. To the extent required by applicable law, we will post an updated notice on our Sites to notify you of any substantive changes to the way we collect and use information.

This State-Specific Privacy Disclosure (“Disclosure”) supplements the Power Privacy Notice, which describes the personal information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. This Disclosure is required by the California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act, and serve as a Notice at Collection under the California Privacy Rights Act:

Categories of Personal Information Collected

The personal information that Power collects, or has collected from consumers in the twelve months prior to the effective date of this Disclosure, fall into the following categories established by the California Privacy Rights Act:

  • Identifiers such as your name, alias, address, phone numbers, IP address, or a government-issued identifier (e.g. a social security number or an ID you provide for identity verification, which in some cases may reflect citizenship or immigration status);
  • Personal information, such as a credit card number or other payment information;
  • Information that may reveal age, gender, race, sexual orientation, or other protected classifications;
    Commercial information, such as the details of a product or service you purchased if a third-party service provider
  • Geolocation data, such as the location of your property; and
  • Audio or visual information, such as images collected or voice recordings stored in connection with Power Services.

Categories of Personal Information Disclosed for a Business Purpose

The personal information that Power disclosed to the third parties identified in the “How We Share Information” section of the Privacy Notice about consumers for a business purpose in the twelve months prior to the effective date of this Disclosure falls into the following categories established by the California Privacy Rights Act:


Audio or visual information, such as images collected or voice recordings stored in connection with Power Services

  • Identifiers such as your name, address, phone numbers, IP address, or government identifier;
    Personal information, such as a credit card number or other payment information;
  • Commercial information, such as the details of a product or service you purchased if a third-party service provider is assisting to provide that product or service to you;
  • Internet or other electronic network activity information to help us analyze our devices and services;
  • Geolocation data, which may constitute precise geolocation data, such as providing a subcontractor the location of your property to perform an installation;
  • Audio or visual information, such as images collected or voice recordings stored in connection with Power Services

Your Data Rights

You may have the right to request access to, the correction of, or the deletion of your personal information, information about the collection of your personal information by Power, or your personal information in a portable format in which case you should contact us at the options provided in the “Your Information Choices” section of the Privacy Notice. You may have the right to opt out of the processing of your personal data for targeted advertising, as defined by the Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act, or the sharing of your personal information for cross-context behavioral advertising, as defined by the California Privacy Rights Act; however, note that Power does not share your personal information for such purposes.


No Sale of Personal Information

In the twelve months prior to the effective date of this Disclosure, Power has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.

California Privacy Rights Act Sensitive Personal Information Disclosure

The categories of data that Power collects and discloses for a business purpose include “sensitive personal information” as defined under the California Privacy Rights Act. Power does not use or disclose sensitive personal information for any purpose not expressly permitted by the California Privacy Rights Act.

California Privacy Rights Act Retention Disclosure

We keep your personal information to enable your continued use of Power Services, for as long as it is required in order to fulfill the relevant purposes described in the Privacy Notice, as permitted or as may be required by law, or as otherwise communicated to you.

California Privacy Rights Act Non-Discrimination Statement

Power will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.

California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act De-identified Data Disclosure.

Power may use de-identified data in some instances. Power either maintains such data without attempting to re-identify it or treats such data as personal data subject to applicable law.

Colorado Privacy Act Profiling Disclosure

Power does not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.
